These include 1,3-butadiene, trichloroethylene, tetrachloroethylene, vinyl chloride, and formaldehyde. If the public notification regarding these chemicals goes forward as planned, it will expand the number of controlled toxic substances to 114.The Toxic Substances Control Act stipulates that chemicals listed as toxic by the EPA can be manufactured, transported, and sold only with special authorization. In addition, companies must keep a record of the status of substance handling, use, and shipment.With the listing of the substances, their use will be expressly restricted. The draft stipulates that tetrachloroethylene is prohibited from use in correction fluid and felt-tip marker ink. Vinyl chloride is prohibited from use in refrigerants, extraction solvents, and propellants. Finns which have been using any of the five substances in ways not expressly permitted by the new controls can apply to the EPA for an expanded list of permitted uses. This application must be received within six months from the upcoming public notification.The use restrictions require that general users must first obtain a use authorization document. However, users whose current amount in use and in storage totals fifty kilograms or less do not need to apply for use authorization. Registration of the use of the substance will suffice.To help prevent chemical disasters, any site that produces, uses, or stores more than ten tons of the newly listed toxic chemicals (other than tetrachloroethylene) at any one time, or 300 tons in any one year, must submit an emergency response plan to the local governing authority for approval, and then establish an emergency response system in accordance with that plan. In addition, the company must install continuous detection and warning equipment at appropriate points within the factory's region of operations, to detect volatilization or leaks as early as possible.In order to effectively reduce the threat posed by toxic chemicals, the Bureau of Environmental Sanitation and Toxic Chemicals Control explicitly requests the reduction of volatilization. In the future, companies with over a certain amount of volatile substances will have to submit production process improvement plans, volatilization reduction plans, and operational management plans for their toxic chemical production equipment, storage troughs, and delivery pipes. In a June 24 public hearing the EPA's Bureau of Environmental Sanitation and Toxic Chemicals Control announced that it planned to add five new chemicals to its list of toxic substances. These include 1,3-butadiene, trichloroethylene, tetrachloroethylene, vinyl chloride, and formaldehyde. If the public notification regarding these chemicals goes forward as planned, it will expand the number of controlled toxic substances to 114.The Toxic Substances Control Act stipulates that chemicals listed as toxic by the EPA can be manufactured, transported, and sold only with special authorization. In addition, companies must keep a record of the status of substance handling, use, and shipment.With the listing of the substances, their use will be expressly restricted.
