In order to reduce the risk to users, the EPA’s recent announcement also classified tetrachloroethylene as a toxic substances. Use of tetrachloroethylene is now prohibited in correction fluid solvent and ball-point pen ink solvent. In addition, substances containing more than the controlled concentrations of vinyl chloride may no longer be used in coolants, extraction solvents, or propellants.The only permitted uses for the five chemicals are those explicitly listed by the EPA. If, prior to the announcement, a company has been using one of the five chemicals for a purpose not listed in the announcement, it may petition the EPA within six months of the original announcement for a supplementary announcement.Importers and vendors of the announced substances must complete permit applications before October, 1998; while manufacturers and users must apply for permits or use certification documents before April, 1999. However, those with less than fifty kilograms of a given substance in use or in storage can receive use authorization simply by registering for future inspection.Restrictions on operations management are as follows: any site which manufactures, uses, or stores more than 10 tons of 1,3-butadiene, trichloroethylene, vinyl chloride, or formaldehyde at any given time, or 300 tons over the course of a year, must submit a plan for the construction of an emergency response system by June 30, 1998. After this plan is approved by the competent authority, the emergency response system is to be fully implemented according to the plan by April, 1999. Companies are also required to install continuous monitoring and warning equipment at a suitable location on the site for early detection of fugitive emissions and leaks, thereby preventing the occurrence of chemical disasters.In order to reduce the hazards of toxic chemicals, companies using amounts in excess of those listed above must, by April 31, 1998, propose production process improvement plans and fugitive emission reduction plans. In addition, operation management plans for manufacturing equipment, storage vessels, and transport equipment that handle these chemicals must also be prepared. After the EPA approves the plans, they must be implemented accordingly by April 31, 1999.
