The EPA, in line with the London Convention, has drafted Waste Materials Classification Standards for Marine Disposal in accordance with Article 22 of the Marine Pollution Control Act. These standards divide waste materials intended for marine dumping into three classes: A, B, and C. Class A materials are those which are strictly forbidden to be disposed of at sea. As the waste materials not allowed to be disposed of at sea under the EPA’s existing Standards for Industrial Waste Storage, Collection and Treatment Methods and Facilities (事業廢棄物貯存清除處理方法及設施標準) and under the London Convention are similar, the EPA has chosen to base its definition of Class A materials primarily on the Taiwanese regulations. Class B materials may only be dumped subject to the issuing of an official permit by the central competent authority. A permit is required each time a dump of Class B materials is conducted. In the past, Taiwan had no clear legal definition of the materials included in Class B in this draft. Therefore, the EPA has based its definition of Class B materials on the London Convention and related regulations in Japan and the US. Class B materials are also separated into liquid and solid categories. Class C materials are defined in this draft as they are under the London Convention. Any material not included in Class A or Class B is automatically regulated as a Class C material.
Aiming to apply the polluter pays principle to sea dumping, the EPA has formulated Marine Disposal Fee Regulations in accordance with Article 12 of the Marine Pollution Control Act. These fees will be levied based on the type and volume of waste material and the degree of impact on the ocean environment of this material. These regulations detail fee payment, calculation, and collection methods, payment deadlines, and other fee regulations.
The EPA has also drafted Standards for the Designation of Marine Disposal and Incineration Zones in accordance with Article 21 of the Marine Pollution Control Act. In drawing up these standards, the EPA has studied related Japanese and US regulations and experiences and has given careful consideration to the locations of sensitive marine environments and fishing areas. These standards delineate five areas in waters off the northwest, west, southwest, southeast, and east of Taiwan and designate one marine disposal zone in each of these areas. These standards also provide one marine incineration zone, located further off the southeast of Taiwan. In addition, these standards detail usage regulations for designated zones, including geographical coordinates, water depth, distance from the shore, total surface area, primary disposal uses, and usage periods.
The EPA is proud to present these three new drafts. In addition to providing comprehensive regulations for marine disposal and incineration in Taiwan, they also demonstrate Taiwan’s determination to comply with international conventions in order to protect the marine environment.
