To help the public understand the process of legally identifying chemical substances as toxic, the EPA on August 1st officially announced the Working Principles for Selecting Toxic Chemical Substances. These principles will become the guidelines used by the EPA to formally list toxic chemical substances.According to the Working Principles, EPA selection of toxic chemical substances will be divided in to four stages. First, the EPA will review the US's Toxic Chemical Substance Control Act (TSCA), the European Union's 76/769/EEC regulations, the Japanese Chemical Substances Review Act and Toxic and Severe/Intense Substances Prohibition Act, the US's Clean Air Act and Toxic Release Inventory (TRI) and other related regulations and listings of toxic chemical substances. This information will then be used to generate a list of candidates for control within Taiwan's regulatory framework.Once the group of candidate chemicals has been established, the EPA will evaluate each of the candidates based on data concerning toxicity. The EPA will then select those chemicals which are to be listed as controlled.Chemicals listed as controlled by the first two stages, will be further evaluated according to amounts produced and imported. If in one year, more than one hundred tons of a given chemical substance are produced and/or imported, it will be listed as a priority control item.In the final stage, the EPA will consider each substance's chemical attributes, its domestic transportation situation, how it is controlled abroad, and the level of potential disaster it poses. Through an assessment of these factors, the EPA will establish priority control lists on a batch-by-batch basis.The Working Principles require the EPA to publish through its information network the lists of selected substances upon completion of each of the stages outline above. These lists will be publicly available for review on the EPA website ( http://www.epa.gov.tw/toxic/index.html)The EPA's Bureau of Environmental Sanitation and Toxic Chemicals Control has indicated that the EPA has already performed initial selections in accordance with the recently promulgated selection principles. The EPA has established the lists of candidate chemical substances, controlled chemical substances, priority control chemical substances, and priority control chemical substances to be first batch of 417 items as candidates for control listing, 232 items as listed controlled chemical substances, 54 items as priority controlled listings, and 8 items as the first priority-batch to come under regulatory control. Bureau personnel have recently stated that from the priority list two more substances have been selected and will be combined with the eight first-batch priority control substances. Toxic Substance Management Of the large number of chemical substances those that are harmful to humans number in the thousands. To help the public understand the process of legally identifying chemical substances as toxic, the EPA on August 1st officially announced the Working Principles for Selecting Toxic Chemical Substances. These principles will become the guidelines used by the EPA to formally list toxic chemical substances.According to the Working Principles, EPA selection of toxic chemical substances will be divided in to four stages.
