The EPA has not yet decided to first create a set of articles and then define and announce in rounds the regulatory criteria of individual projects, or to set and announce regulatory criteria and standards according to the circumstances of each project category.
An important principle of the draft stipulates that only construction projects classified as “major projects” will be targeted. The land area required by a given structure will be used to define project criteria. The EPA will select an appropriate percentage of projects based on the comparative distribution of construction activities and the structural total floor area. The EPA will discuss this calculation method with concerned parties once related information has been prepared.
To control air pollution generated by construction activity, current control methods target construction sites as a unit. In the future, however, controls will require contractors to be responsible for the air pollution generation by construction related transportation activities. The draft articles stipulate that construction vehicles must be fitted with sealed anti-dust equipment and that construction vehicles and equipment must be cleaned before they leave the construction site.
In addition, contractors will be responsible for cleaning transport routes within a short distance of construction sites used by construction vehicles and equipment. Transport routes must be washed and swept regularly so no obvious dust or grime remains. Other materials to be brought under control including stones and gravel cannot be left outside the construction site.
It is important to note that local governments will have some discretion in setting air pollution controls on construction projects. After the Construction Project Air Pollution Control Regulations are implemented, local competent authorities may still set tougher controls for specific areas based on air quality control needs.
On September 23, the EPA discussed the above items with relevant parties. A preliminary draft will be completed in two to three weeks.
