However, when it comes to the use of these agents, the average person is quite unfamiliar with which government department has jurisdiction and which regulations apply. The management of environmental pesticides was originally based on the Regulations Governing the Management of Environmental Pesticides, implemented according to amendments announced in 1984. Promulgated through executive order, rather than passed by the Legislative Yuan, these regulations have been insufficient to restrain and deter businesses in their use of environmental pesticides. Negligent manufacture, use or handling could quickly lead to environmental pollution and in some cases pose a risk to human health. Moreover, rapid advancements in local technology, industrialization, and urbanization have led to an increase in both the development of environmental pesticides and their rate of use. This has in turn caused a corresponding rise in the potential dangers and risks associated with them. Faced with these developments, the regulatory effectiveness of the current executive order has clearly proven inadequate.In response, the EPA has actively researched related regulatory systems both locally and abroad, reviewed past efforts, and drafted the Environmental Agents Control Act. The act, passed by the Legislative Yuan on October 23, 1997, and formally implemented through presidential order on November 10, represents a major step forward in the regulation of environmental agents in Taiwan.The following are key points in the Environmental Agents Control Act:1. The range of controlled environmental agents has been broadened to include chemical and biological (such as microorganism-producing) agents for use in environmental sanitation and pollution control. The advertising of environmental agents and the management of the vector control industry are also governed by the act thus providing consumers with an additional safeguard in the selection and application of environmental agents.2. Permit application, record keeping, and auditing systems will be incorporated into the scope of legal control. All aspects of the production and use of environmental agents including manufacturing, processing, packaging, distribution, import, export, vending, storage, use, testing & research, demonstration of appropriate use, and disposal will be strictly regulated by the act.3. The production of counterfeit, prohibited, and inferior environmental agents will be controlled. However, in the interest of flexibility and practicality, the EPA has the right to formally announce as outside the scope of control the production and use of environmental agents with toxicity levels that do not pollute the environment.4. The EPA has been given the authority to set enforcement rules for the act and will prescribe a total of 16 related regulations and statutes to further supplement the act.The primary difference between the new act and the previous regulations governing environmental agents used for environmental sanitation purposes is the severity of the penalties involved. The production, processing, or import of counterfeit or prohibited environmental agents can now be penalized; and other violations of the act will be met with penalties commensurate with the circumstances of the violation. The new act will thereby serve as a much better deterrent than the former regulations which could only set deadlines for improvement or a require that a permit be revoked.The EPA hopes that the announcement and implementation of the new act will raise the standards of environmental agent use in Taiwan.
