With such rapid changes, the general public and industry have difficulty understanding environmental regulations. These groups are thereby unclear on what form their participation in the environmental regulatory decision making process should take.In the administration of environmental protection activities, the decision making process should involve input from and build consensus among all sectors of society. With widespread participation, society should be able to create environmental protection measures that are concrete and feasible. At the same time, the conflicts between control measures and the economics of production should be achievable. With this in mind, EPA Administrator Hsung-Hsiung Tsai has been actively promoting efforts to enhance the transparency of the process for developing environmental regulations and policies.In the process of amending laws and regulations, after relevant EPA bureaus or offices have finished review of a draft, a public hearing or discussion meeting is called. A policy report is then submitted to the Administrator, and the draft is comprehensively reviewed and modified by the EPA's Laws and Regulations Committee and the department overseeing the draft. Finally, the draft is approved by the Administrator and formally announced.For external parties, this policy development process provides limited opportunity for clarification and input. It also provides little opportunity for becoming familiar with the system. Only during public hearings can external parties understand the contents of the draft. And, only after the draft has been formally announced can external parties review any changes.As an improvement measure, the EPA has instigated several discussions and studies on how to open up the regulatory process to greater public participation and how to incorporate opinions from all sectors into the draft review process. After consideration by all EPA departments, the following suggestion for improvement has been made. After the relevant bureau or office has finished the draft, concerned parties will immediately be able to review the draft on the EPA's information network. In addition, following the administrator's instructions on policy development and the subsequent modification by the bureau or office in charge, the newest version of the draft will again be posted on the network. This posting will also include minutes from related public hearings and a comparison of the changes made to date.Following this, in order to help external parties achieve an earlier understanding of the clauses and items in publicly announced regulations, the EPA will upon publishing the regulation put the clauses on the EPA's web site, under the "laws and regulations" page. This will allow the public and industry to easily obtain the most recent information on changes to environmental laws and regulations.An EPA official indicated that this change in the regulatory development process will be implemented in the near future. General Policy The scope of environmental issues is extremely broad and solutions to environmental problems frequently require specialized technology. To comprehensively raise environmental quality, the EPA has been rapidly amending environmental protection laws and regulations. With such rapid changes, the general public and industry have difficulty understanding environmental regulations.
