The EIA Review Committee will use these items as standard references during the EIA review process.EPA personnel have indicated that the Reference Items will be used in general review cases. For special cases, however, the EIA Review committee will still make judgments according to the individual characteristics of the case at hand. Future reference items, once they pass EIA Review Committee’s approval, will be in effect for use by the EPA review process. Within local government bodies, however, these future items will not be binding; they will be for reference only.In addition to listing the items for attention within the general EIA review process, the Reference Items will also provide detailed review standards for development activities in residential slope-land areas, water source protection areas, agricultural land, coastal areas, and other specially designated areas.According to the Reference Items, future EIA review activities will consider five separated areas of impact: basic environmental factors, the surrounding ecosystem, environmental pollution created by the development activity, effects on natural and cultural scenery, and the impacts to society. The geographic area considered by EIA reviews will include the development area itself and the area impacted by the development activity.For alternatives, the Reference Items requires them to be covered within the first stage EIA review. This review process will consider five levels: economic benefit, technical feasibility, environmental protection measures, social impacts, and disaster risks. In review of policies which lighten environmental impacts, these must include changes to plan contents, changes to scope, location alternates, alternate facilities and pollution control measures, as well as the counter-measure’s efficiency and degree of improvement.As for review of development activities in specially designated areas, such as mountain slope residential areas, the Reference requires that average depth of digging or height of filling be less than two meters and that the change of slope after land preparation cannot exceed 15%. Furthermore, after completion of land preparation within the development area, the greenery coverage rate of the slope area should be more than 95% within six months. Similarly, following completion of development, the forest regeneration rate must reach more than 50% of the entire area.For development activities in water source protection areas, the Reference Items prohibit development activities in the following cases: in reservoir catchment areas, in areas one kilometer from bodies of water, in areas one kilometer upstream from water extraction facilities, in areas where the quality of water in surrounding bodies of water already exceeds legal standards, and on land that has an average slope angle greater than 30 degrees.The Reference Items also require that EIAs for agricultural development activities provide measures for mitigating pollution to surrounding land. Also, after conversion of agricultural land, if the new activities differ from the originally intended activities, a greenbelt of the proper size should be maintained.For development activities in coastal areas, the Reference Items have a special requirement for activities that occur within sensitive areas such as wildlife habitat, ecologically sensitive areas, or water resource areas.
