However in the two years since the implementation of these standards, the EPA has often heard the call for modifying the regulations. In response, on August 13th the EPA promulgated amendments to the Standards.EIA requirements governing development activities on mountain slopes have become more stringent.The original standards required an EIA for those development activities in which building construction occurred on more than one hectare of land. The new standards now require an EIA for development activity on a mountain slope where the total development area exceeds one hectare.For industrial development activities, the original standards required manufacturers in the metals smelting and petroleum refining industries that either built new facilities, added production lines, or increased production capacity by more than ten percent to perform an EIA. Under the revised regulations, manufacturers in these industries that establish new facilities, expand production lines, or increase production capability in environmental sensitive areas (such as national parks, etc.), or on mountain slopes where development will exceed on hectare, must perform EIAs.In less sensitive areas, if the expansion is over 10%, the developer must still undertake an EIA. However, if the activity does not produce an increase in the amount of air pollution, water pollution, or solid waste generated, then, with proper review and approval, the developer may be able to avoid having to perform an EIA.For industrial park development, the original regulations required developers to perform an EIA if the park was planned for development on land zoned for urban use. Under the new regulations, however, only industrial park development on urban land that exceeds five hectares must undergo an EIA. Industrial parks that are developed in accordance to the Articles for Promoting Production Upgrading must perform an EIA according to the land area stipulated in the Articles.The new standards also have a number of new requirements for environmental protection construction projects. For sewer system construction, the new standards only require an EIA for wastewater treatment plants occupying land area over a specified number of hectares. The new standards also use new methods for determining the regulated scale of landfills and incinerator (and resource recycling) facilities handling general, non-hazardous industrial, and hazardous industrial waste. Previously, these facilities were required to perform EIA based on the daily treatment amount of waste. Due to the difficulties of determining these amounts, however, use land area of the development activity as the determining factor.The EIA regulations governing waste soil from construction sites have also been amended. Considering the relative compositional simplicity of waste construction soil and the relatively small environmental impact of disposal, the regulated scale of disposal have been eased. Now only projects covering more than ten hectares, rather than the previous five must undergo and EIA.To encourage the establishment of environmental protection projects, if a project is within the scope of an industrial park or other development activity that has passed an EIA, and the amount of total pollution emitted does not exceed the limits of the original EIA, then a project may be eligible to have the EIA requirement waived by the local relevant authority.
