The Executive Yuan called a meeting of relevant government bodies to evaluate the amendments, which were ratified by the Executive Yuan on August 21.Among the most important advances in the new amendments to the Air Pollution Control Act are the rules governing total pollution quantity. Although the current law contains provisions regarding total pollution quantity controls, these have been hard to implement. There are currently very few cases for which total pollution quantity control is carried out according to these provisions; in general, control measures are still directed at the emissions density of individual pollution sources.In order to further improve air quality and apply economic incentives to the reduction of pollution, the new amendments to the Air Pollution Act stipulate that the EPA will lay out quantity control areas based on geographical and meteorological conditions, and fix the total allowed pollution quantity for each area. The pollution quantity allotted to each fixed pollution source will be determined by the governing environmental body of the city or county where the source is located. If the pollution source exceeds its allotment, it will be required to make improvements within a specified time period. If its pollution quantity is below its allotment, then it can reserve the balance as "emissions rights." Since new fixed pollution sources have no allotment, they will be forced to use the emissions rights of someone already possessing them (for example, by purchasing these rights). The details of quantity control will be entrusted to the central governing authority, who will formulate them in consultation with other affected organizations.The second change effected by the amendments is to apply more explicit regulations to air pollution fees, covering their domain of application, fee collection organizations, fee collection methods, rate structure, spending items, fee reductions, and incentives. Air pollution fees for construction projects will be collected by the central governing authority rather than city or county level bodies. Fees will be based on air quality, type of pollution source, type of pollutants, fuel type, and pollution prevention costs. The draft revisions also contain a number of stipulations setting penalties on those who do not pay the fee, or pay late.In consideration of the importance of "clean fuels" in reducing vehicular air pollution, the draft revisions empower the central governing authority to set standards for fuel ingredients and performance. To launch the "clean car" policy, the revisions require automobiles to obtain a "Vehicle Model Exhaust Inspection Certificate" before applying for a license plate. Vehicles that are deemed substandard upon roadside inspection or remote monitoring must be repaired within a certain time period and taken to a designated location for inspection.Now that the draft amendments to the Air Pollution Control Act have been passed by the Executive Yuan, they will be sent to the legislature for ratification.
